Legal Question in Real Estate Law in Texas

My dad left our old home to my sister and I. Only, my sister refinanced the home under her husbands name. My father had a mortgage of $80,000 and the home is worth $140,000. She refinanced it at $130,000 giving her a check of $50,000. At closing, she was told to give half of this amount to me. 4 years later I have not received anything and she will not discuss it with any of the family who have brought it to her attention. What can I do? In addition, my sister is a house wife and her husband is a border patrol who brings home an average of $80,000 per year. Again, wat can I do?

If your sister refinanced a house in which you are a co-owner, without your consent, then you have a title claim. You can make a claim against the mortgagee policy that was issued to the new lender. You should contact a local real estate attorney to help protect your interests
