Legal Question in Real Estate Law in Texas
Damage on my property
Someone who did not know how to drive has drove into our shoe store over the labor day weekend and made 5000 worth of damage... We got the message from the next store who has seen what happened earlier the same day. By the time we got there the person is gone w/ the car and our store was all broken. Fortunately we have found a license plate that was stuck and fell between security bars. I have filed the police report, and would like to know what further action I have to take.

Re: Damage on my property
Hello there --
I'm sorry to hear of your property damages. It takes a true coward to flee from responsibility, and this person should be found. I believe that the police report was a good first step, as there will be criminal prosecution recourse against this person, if found by the police department. The sad truth, though, is that the police department may never find the person or may not devote the necessary time and effort to do so, considering their overwhelming caseloads. This would lead me to advise you to pursue your civil remedies as well. You could see to an independent investigation of the incident, "track" down this person yourself and sue for damages. With the civil suit, you may also reach other sources that the criminal aspect could not for payment of these costs -- insurance, parents (if this is a juvenile), employers (if the person was driving a company car, on a company errand, etc.) As such, I would encourage you to speak to an attorney in your area to pursue this possibility.
