Legal Question in Real Estate Law in Texas
Deceased Parent whom was remarried
My father remarried after my mother passed away --- my mother left a Last Will & Testament, which was probated after her death --- my father also had a Last Will & Testament prior to him remarrying --- Howeve, after he was remarried --- his new wife and her children had him change his will --- The 2nd Will which was witnessed by the 2nd Wife children has not been probated since his death --- The home in which they lived became 2nd Wife's Homestead --- before her death she was placed in a nursing home (abandoning her homestead), but her children/grandchildren never notified all my father's children --- Now his wife's grandchildren have placed the house for sale and have filed a Quick Claim Deed declaring ownership of home --- In the process they have also falsified other documents which were sworn to and notarized --- What can we do so stop the sale of this property?
