Deed Restriction Changes

My homeowners association asked for a deed restriction change and said the had the required number of votes to pass. The change was to increase the manitantance fund by $100. This was done in September 2006. They have not filed the change with the Harris county Clurke office. They sent out bills and said they had the right to do that even though it has not been filed. Do they hav the right to do collect the money before it is filed?

That kind of change does not require recordation. You will have the right to reasonably examine the books of the HOA and you should find the change there.
