Deed restriction violation

I have a rental house in Atascocita,Tx. We are constantly getting harrassing letters concerning so-called deed restriction violations. We have gotten letters stating mildew on the brick(1 square foot), dirt on the garage door, one broken piece of lattice work(about 6 inches long), faded paint and many other petty situations. They threaten to fine us if the ''problem'' is not taken care of. Is a HOA within their legal boundaries to fine homeowners for such petty things. The deed restriction document does not list such things as violations. I fel like this is bordering on harrassment.
