Legal Question in Real Estate Law in Texas
divorce decree documents
If the divorce decree states that the husband keeps the real estate, and the wife signed it and Judge signed decree, does that legally transfer the title to the husband. Does she have any rights to the R/E after the divorce has be finalized?

Re: divorce decree documents
The court order legally takes care of it, but the attorney should have had wife sign a deed into the husband as well. If the title company requires a deed and wife fails to cooperate, then husband's remedy is to quiet title into himself. However, the judge may award husband legal fees to be paid by wife for her failure to cooperate in finalizing title. She would have no rights post-divorce.
