Legal Question in Real Estate Law in Texas
A drunk driver drove through our fence, into our above ground pool, running over my vegetable garden, and one of my son's bike. The water rushed through the yard into the kids' sand box and moving another garden's fencing/white marble rocks. Can I add the water damage and stress/aggravation/loss of family entertainment to the claim especially since she doesn't have insurance?

The water damage--possibly. Although if this person doesn't have insurance, it's unlikely that you'll get much out of her. You can seek to have her driver's license suspended until she pays for the damages. You're much better off going through your homeowner's insurance.
