Earnest money/deposit

We put down 500 dollars on a house as earnest money and the morgage company sent them a letter saying we would be qualified by the time the house was built. Well we didn't get qualified on the house and our mortage company sent the denial letter to the builder but they refuse to give us our earnest money back. Is this legal? If not what can I do?

You can sue them in small claims court. As a consumer, you might be eligible for triple damages, so ask for 3 x your loss plus, ask for reimbursement for all of your expenses. Good luck.
