Electric Pole In Our Yard
We have a house next door that the ugly house folks would not buy.
The electric poles to service this place are 5 feet on our yard and we paid to have the poles put in years ago. We paid to have an electronic meter installed. The electicity to this place has been cut off for several years. Recently it was purchased and we have another terrible owner. We do not want these new people to use our pole because the electric company is in our yard constantly. The electric company cut the wires last time and have no connection at all to this house so all new wire will need to be strung. We have told the electric company we are denying access for them to use our pole for these neighbors. Our yard is fenced completely with no trespassing signs.
Will this hold up in court? What procedures will the electric company need to get access to our property?
We are just sick of this house and bad neighbors.........

The utility company probably already had an easement to do this, but if they didn't they would sue you in court to get it and you would fight over how much they would have to pay you. An attorney can go over your title with you and handle any condemnation proceedings that were filed by the utility. But they will ultimately be able to do it.
