Legal Question in Real Estate Law in Texas

employer wants to withhold my commission

I'm a loan officer for a small mortgage co. I handled a $5,000,000.00 deal which was approved by the broker, the owner of the mortgage co. and Countrywide who was going to buy the loan. Everyone was in approval of this deal. After the deal was finalized Countrywide reneged on the deal. My employer wants me to repay the commission I received. They also want to keep over $1,000 in referral fees on other deals I had. Is what they are doing illegal? Do They have the right wo withhold my commission as repayment of the commission they paid me? Since Countrywide reneged on the deal after having approved it, I don't feel I should have to repay commission and referral monies. Do I have a case against my company, the broker and the owner of the co.?

The answer is probably, but it will be in your contract with your employer.
