In Florida, the ocurence of the wedding gives no automatic interest in the pre-nuptially owned real estate of the spouse.

Howdy:

I assume you owned the property before you got married, and that only your money was used to buy it.

Where do you live now? If you live in Texas and own Florida real estate, your Florida property will typically remain separate property.

However, any income earned on separate property is considered community income in Texas.

And, if community money is used to pay down the loan or make improvements, the community will be entitled to reimbursement, if that became necessary.

I will leave it to a Florida attorney to address the reverse situation.
