Legal Question in Real Estate Law in Texas

End Lease contract

We are international students and we signed a contract for a year, with the real intention of living here the whole year, the problem is that we are required to go back to our country this december so this will leave 5 months of the contract out. We need advise because the contract says we are liable for the whole lease period, but we are in no position to pay all those months...

What do you recommend....

Re: End Lease contract

Notify your landlord that you will have to move before the lease expires. Do so in writing. Advise him that you will cooperate with him in an attempt to rent the unit when you vacate it, and show the unit to his prospects as well as your own.

If he rents the unit with no break in income you will be able to leave owing nothing. If not, surely the short time you will be liable for the rent while it is rented to another will be far cheaper than simply walking away and incurring liability for the full 5 months plus costs and attorney's fees.

Also, consider subletting the unit to another for the balance of the lease. This may require your landlord's approval.
