Legal Question in Real Estate Law in Texas
one entrance to two separate properties
my wife inherited the home and the property where she grew up. the house has been at its location for over forty years. our, my wife and i, property is surrounded by another relative that inherited the property recently. an ezment was never drawn up because the property the relative now owns belonged to the grandfather. he never had a problem with his daughter and husband(my wife's parents) using the entrance. their property shares the same entrance and is the only entrance to both properties. Does the relative have the right to enclose the entrance which enables us to enter our proerty?

Re: one entrance to two separate properties
If that is the only way into your property, no. By statute, an owner of real estate cannot be landlocked. An attorney can draw up an easement agreement between you and your neighbor that is filed of record and will prevent any future misunderstandings.
