Legal Question in Real Estate Law in Texas

Many errors on a mortgage contract - Is it valid?

There are multiple errors on the mortgage contract. (Name misspellings, non initialed items, etc.) Deed was supposed to be in both parties names, but mortgage only in 1 person's.

After reviewing the contract we noticed that they list both individuals as ''borrower's'' and had both parties sign multiple documents to repay, although some paperwork only lists 1 individual as borrower. Only 1 party signed to allow them to correct clerical errors.

Can this contract be voided?

You would need an attorney to review the actual documents and errors. When things are ambiguous, the courts look to the "intent" of the parties.
