Legal Question in Real Estate Law in Texas

Escrow

On August 8,2000 we received a check for $1561.80 to fix our roof. The man we are buying the house from told us to hurry up and sign the check since it was made out to both my husband & I and him. He cashed the check and gave me a piece of paper saying the money was in escrow till we fixed the roof. The roof is still in good condition therefor we haven't fixed it. My question is does he have the right to keep this money all these years and when we fix the roof what do we do? We are the ones paying the home insurance.

Whatever recourse you may have had is probably long gone due to the statute of limitations.
