Legal Question in Real Estate Law in Texas

can evict husband?

I bought a house with my boyfriend,

we are both on the deed but I am

solely on the note and title, we

married 3 months after we bought

the house(I actually just looked on

the deed and it says husband and

wife when we were not married yet

for another 3 months. It then

became apparent he married me just

to get citizenship. When I wouldn't

sponsor him he became abusive and

I had to leave. He is now in the

house and not paying the mortgage,

he said he will not sell and will not

leave because he put money down.

What legal right do i have to get him

out so I can sell or rent it? Should I

foreclose. I'm afraid if I tell him he

has 30 days to get out he will trash

the house, like he threatens? He

also will/ can not assume the loan

because he is not a citizen or doesn't

have credit, not sure as he is a

compulsive liar. I'm afraid for my life,

he's crazy not to mention he has

ruined me financially? Please help.

Thank You

Re: can evict husband?

Get a good divorce lawyer. You will need a restraining order to have him removed from the property.
