Legal Question in Real Estate Law in Texas
My ex-husband and I got a divorce years ago. The house is in both of our names. The house was awarded to him in the divorce. He is still in the house but I want my name off the loan. He says he can't refinance the house or sell it due to a bankruptcy. My question is how can I get my name off that house?

You can't, absent a sale or refinance. Does the divorce decree obligate him to get you removed? If so, you might be able to force him to sell. Otherwise, you could try contacting the lender and asking to be released, but they don't have to agree. If you go this route, communicate strictly in writing with all relevant facts: loan number, balance, current value of the house, how long you've been divorced.
