Legal Question in Real Estate Law in Texas

Fences and property boundries

I recenetly had my property surveyed and found that the old fence is not on the my property line. In fact the survey shows that my neighbors barn is 2 foot on my property on the north end and 3.7 feet on my property on the south end. Where can we legaly put our fence? He has threatened us if we don't put it back where the old fence was.

Sounds like a boundary line dispute. You have every right to place your fence on the true property line. However, it looks like your neighbor is trying to bully his way into owning your strip of land by adverse possession. If it were me, I would offer to sell him the strip at a reasonable price, otherwise you can request that he move his barn, but be aware, to avoid a Hatfield and McCoy feud, you should probably get a court order.
