Legal Question in Real Estate Law in Texas

Flood insurance not disclosed

A week before we were to close on the property our real estate agent tells us that we need flood insurance on the property and our lender requires it. It was not disclosed on any of the documents that we signed. An elevation survey was done and its on a high flood risk area. Can we cancel the contract?

Re: Flood insurance not disclosed

Read your contract and Seller's Disclosure for options to cancel. If you don't understand the documents, you should have an attorney review them. You can also challenge the lender's requirement. I have been able to successfully have the requirement removed when I could prove the property was not in a flood zone.
