Legal Question in Real Estate Law in Texas

I found out a house was going to be available to rent after looking at another property from this renter. I took a look at the house very shortly after the previous renter moved out before the house was actually available to be shown, i told her I would like to rent the house once it was finished being renovated. I came by the renters place of business and gave her the deposit for the house and she gave me the blank lease to fill out and return with the rent when it was ready for us to move in, which we assumed would be done by May 15th. On May 4th I lost my job and called her two days later to inform her we could not rent the place due to lack of funds. That weekend she put a for rent sign back on the property. 3 weeks later (and the house is still being worked on) i have not confirmed my deposit will be returned...Is this something i should take as a loss?

As long as you didn't sign a lease, the deposit should be returned. If she fails to do so, you can sue in small claims court and ask for court costs as well.
