Legal Question in Real Estate Law in Texas

fraud, signed over property to father, can i get it back

my father called out of the blue told me my property was being forclosed on. i had no prior knowledge of this. no notice from the bank etc. long story short he caught me on my way out the door going to work, he gave me an hour and a half to decide. this was my option, sign over the deed to him and he would pay it off then sell it back to me with no stress of a bank and paying late. with no time to investigate and not believing him for a moment utterly terrified of losing my home i agreed and signed a warranty deed or quit claim deed. he immiediatly evicted me. at this point he said it was to make some repairs for my benefit and that in about two weeks i could move back in. that was dec.2001 and he still has my property. i have tried all this time in vain to get my home back under the terms i agreed upon at the time i signed it over to him. he now wants 10,000 over what i was paying for it. i can find no evidence of forclosure whatsoever. his sister works at the bank where i had my home loan. how could my home be in forclosure and me not know yet my father did? do i have grounds to sue him and get my home back or at least what i paid into it if he will not give it back?

Sounds like the father of our dreams...or nightmares! I am sure there is a little more to this story, but assuming what you say is true, you do have legal recourse. It involves a lawsuit against your father if he is unwilling to a compromise. FYI, my lawsuits start at $2,500 and go up from there. Best of luck.
