Legal Question in Real Estate Law in Texas

A group of 8 individuals from San Diego has been purchasing notes from a guy in Fort Worth TX. He is 3 months late on payments and hasn't returned our calls/text/emails for awhile. We are in the process of getting a lawyer in Fort Worth. Should we sue the guy individually or together as a group?

It is probably better to all sue as one unless one of you has invested more than the others. If you all sue seperatly the judge will probably combine all the case then you each will be paying for an attorney when you guys could split the cost of the attorney in case the person you are suing is insolvent and you cannot recover from him.
