Legal Question in Real Estate Law in Texas

Hi,

I lived in the state of Texas and my property is under pre-foreclosure status

Been working with lender on a loan modification, which I have been approved

but the problem is that my ex husband does not want to sign the new loan terms

My ex husband has filed a Quit Claim of Deed where he is giving all the rights and interest of the property to me

Can I use this QuitClaim of Deed instead of his signature to proceed with the new loan terms?

It's up to your lender. However, most lenders and title companies would have rather had him sign a special warranty deed, and not a quitclaim.
