Legal Question in Real Estate Law in Texas

HOA rules.What does it mean

Our home owners association rules state;

'' Boats, trailers, campers,, recreational vehicles,motor homes,unused or inoperable

automobiles and other machinery consistent with the use of the premises as a residence may be kept on lots, provided they

are kept or stored within a garage or such other place as may be completely out of view from the Common area or any street or adjacent Lot.''

The Bord of directors has stated that this means{ the other machinery part specifically} that any vehicle that is commercially used must be kept out of site. Whether a large semi rig or a family vehicle with a logo on the side.

Would this be a correct interpretation or is there room to allow vehicles that may have duel use like a company car or SUV?

If this issue was litigated and if I was the judge, I would say "NO." HOA boards have a tendency to get power-happy and sometimes they need to be put back in their place. Unfortunately it takes a lawsuit and there is no guarantee of success. Best of luck
