Legal Question in Real Estate Law in Texas

home owner delimma

Hi

I have purchased a new home with a boyfriend. The relationship did not work out and he now is involved with another person. He is unable to refinance the house but wants to rent the house out. With he involved with someone else and making the payments, so they say. I want to see if there is some kind of contract to protect myself. Is there any advice you can give me?

First, you will not be safe trusting him to look out for your best interest. So you can either sell the house or trust a third party to handle renting it out, collecting the rent and paying the mortgage. But you'll still be stuck owning a hope with someone you probably don't want to be involved with any more. You probably feel like you skipped the marriage and went straight to the divorce. Someone needs to buy this house; either you, him or a third party. You could also consider putting the house into a trust so neither of you can take advantage of the other.
