Legal Question in Real Estate Law in Texas

Home owners association

I am a member of a local home owners association. I own 8 vacant lots in this association. Assessments fees are based on each lot as well as votes on association matters. I want to replat these 8 lots into 1 large lot and build an apartment building. My question is: Can the association stop this replat since the assessed fees will drop from 8 lots too 1 lot? Additionally, there is no mention of lot size in the covenets or building size.

The answer to this question would depend on a variety of matters. The first, and most important, is whether or not this particular area is zoned appropriately by the local government. Sometimes you will need approval from the government before building multitenant structures next to homes. Second, I would have to see the title to the properties to see if there are restrictions built into the conveyances. Finally, I would have to review your agreement with the association, in order to determine your rights.
