Legal Question in Real Estate Law in Texas

My home was sold, with out no notice, and for no reason.

I've recentlly purcashed a new home. I got behind 1 mon.in payment, but told the owners I would pay 2 mon. at once. They told me that the house had been sold to someone esle. Can I sue for my money back that I put into the home.It's over $3,000 that they owe me.There was no contract drawn up, but I have receits of payments.An the first receit stated that I was buying the home.

From the facts that you have given, it appears that you had a very informal arrangement unaccompanied by any paperwork. Yes, you should be able to get your money back. You could file suit in Small Claims Court. A Small Claims Court is presided over by the Justice of Peace. If you are in a county with a non-lawyer JP, it is a risky matter to bring this type of suit in JP Court. It would be better if you retained an attorney to file suit for you. He should be able to recover attorneys' fees in addition to the $3,000.00.
