Legal Question in Real Estate Law in Texas

Homeowner Association Fees

Board decided to file lawsuit on golf course developers. Did not get a vote from residents. Residents never signed anything giving them the authority to make such decisions. Association fees are increased from $248.00 to $550.00.

Legally, must I pay the attorney fee portion they are charging?

Re: Homeowner Association Fees

Beware the homeowner's associations. There are few other more self-important organizations, and they tend to take their perceived power very seriously. Given that they can (and will) file liens and foreclose, your safest course of action is to pay the bill and subsequently complain, or file suit. To answer your question, you would have to review the bylaws of the homeowner's association to see what they can and cannot do. If they operated beyond their powers, then you may have standing to do something about it.
