Legal Question in Real Estate Law in Texas

Homeowners Association failing to maintain property

I own a Condo in a community where it is manditory to belong to the HomeOwners association. The HOA is responsible for the maintenance on the outside of the buildings,ie..exterior paint, front lawns, trees, sprinklers, all common areas, ect.. My dues have always been current. Do I have any legal recourse to get my HOA to plant grass in my front yard, which is currently nothing but bare dirt. There are 7 bare front yards including my own on my street alone. I have made the requests in writing but they have went ignored for a year.

Re: Homeowners Association failing to maintain property

HOA's are usually a nightmare to most folks. Their obligation for yard maintenance may not extend to the installation of the yard in the first place. That may be your job under the CAM agreement.

Check your CAM agreement closely to see who has what rights. Consult a local real estate lawyer if the HOA won't move after being given notice of a situation which is clearly within their sphere of responsibility.

Good luck.
