Legal Question in Real Estate Law in Texas

new house building contract

My fiancee & I recently signed a contract to build a new house on a particular lot of land. Following a recent survey of the land (before the city council would allocate a building permit) it was discovered that our particular house would not physically fit in the lot allocated without encroaching PUE. Does this make the contract null & void between ourselves & the builder? Is any earnest money paid by us to the builder required to be returned to us?
