Legal Question in Real Estate Law in Texas
House entered and cleared out
My fiance and I are renting a house and come to find out it had been foreclosed on. The foreclosure sale took place while we were out of town and came home to a realtor lock box on the door and hired hands empting our property out. We recovered some property as they were loading up the last truck full but not all including valuables and collectibles. What can we do to get the rest of the property that they deny taking but as the house is now empty they had to have taken it? We were never given an eviction notice or anything.

Re: House entered and cleared out
You have a cause of action against the realtor/new owner for damages for failure to properly evict you. If you were not available, service by publication would have been proper and the JP would have issued an order of eviction. If you wish to pursue a lawsuit in small claims court, your damages sought must be under $10,000.
