Legal Question in Real Estate Law in Texas

HI! My husband and I have bought a house in Texas. He is the only one on the mortgage loan. I am his wife and have signed a deed of trust. We have a prenutpial agreement. I would like to pay off the house completely 142000 dollars but want to make sure that I will get 75 percent ownership of the house.

My husband has agreed to do that. How can I secure that I will be the owner of the house to 75 percent in case we separate or divorce in the future? We will be married for 10 years in July of 2010.;

In order to do this, you would need to execute an antenuptual agreement, specifying the terms you mentioned above, and then your husband would need to execute a fractional interest warranty deed for 75% of the property. I would also recommend your using a title company to effectuate the transfer.
