Legal Question in Real Estate Law in Texas

My husband and neighbor drew up a contract to buy her home. She moved with family to Lousiana and he mailed the final check April 2010. They have refused to answer any calls and have not cashed his final payment.

My husband moved 3 times since joining this contract and now he cannot find his copy.

He has all of his checks to show consistent payment. He has a phone number where he usually contacts her, but after 5 messages, they will not return his calls.

Do we have any recourse?

Sue her, and engage in pre-trial discovery in the form of a request for production of documents. Make HER produce HER copy of the contract. If she says she doesn't have it, ask her why she's been cashing your checks all these years.
