Legal Question in Real Estate Law in Texas

My husband and I allow his sister to live rent free in a house that my husband owns (not our primary residence). We also pay for her utilities. In his will, my husband has left me that house. If she is still living there when he dies and unwilling to leave, will I be able to evict her, so I may sell the house, or must I go to court to evict her? Can I evict her even if I am not selling the house?

Yes, you can evict her. I assume that she has no written lease.

If you like, you can even sell the house without evicting her, but it will be more difficult to do so.
