Legal Question in Real Estate Law in Texas

Independent Marketing Contractor

I am an independent contractor for a realtor, acting as a Marketing manager. I am not an agent and have never had a real estate license. Part of my fees as an independent marketing consultant are based upon a percentage of incoming and outgoing, as well as relocation fees. Is that legal in the state of Texas, and can the agent reneg based on non disclosure of this law?
