Legal Question in Real Estate Law in Texas

inherited estate

My grandmother just past away this month and my brother and I are the next of kin to inherite her land and house. We want to sell the property because she is behind on her taxes and also has a judgement on the property. She didn't leave a will and we don't know where to start to begin the process of turning the property to our name with out a will and and we don't understand taxation laws in texas. We know she can loose the prperty at anytime with the judgement so we are trying to move fast. What should we do?

Where was your grandmother living when she died? In texas? if so, I suggest you hire a local attorney in texas to open probate, appoint you and your brother or just you as administrator. If she died here in PA you will need to do the same here, but also in texas for the purpose of disposing of that property.

The good news is that probate is quick and simple in Texas. If your grandmother was a resident of Texas, an heirship proceeding needs to be opened in the county of her residence and title can be transferred to the heirs by the administrator (either you or your brother).
