Legal Question in Real Estate Law in Texas

land use

A public utility wants to put a water tower in our neighborhood. It will be on a vacant lot, zoned residential, between two homes. The tower is to be 130+ ft high. Our neightborhood covenants state the lots are for single family homes but the water company says they can do what they want with the land. Do they have to re-zone the property and do we have any rights regarding the covenants?

You can try and fight it, but you will probably lose. They will have to have the property re-zoned for such a use, so start at the city or county that governs the site.
