Legal Question in Real Estate Law in Texas

Landlord responsibility

The landlord calls an electric company to repair the electricity in a rental home at the request of the tenant. The electric company technician picks up the key at the realty office where a key is kept, at the suggestion of the tenant.

The technician then goes to the home to repair the electricity. In order to access an electric outlet, a bed has to be moved. According to the electric company, the daughter (who happens to be home) of the tenant and the technician move the bed. In so doing, the bed breaks.

Does the landlord have any responsibility in paying for the broken bed?

The tenant claims it was a bad decision on the part of the technician. She also is suggesting that I, the landlord, carry responsibility for payment if the electric company does not pay for it.

Re: Landlord responsibility

I wouldn't get too worried about the issue unless the bed is some sort of antique. It just doesn't seem all that worth the costs of a suit. With the daughter helping the move, there always would be a defense of contributory negligence. Buyt, in today's climate one never knows what people will do.
