I recieved papers back in march stating that i owed my mortagae company four months of rent. When at the time of the law suit papers i owed them 1 month i have all cancelled checks and certified slips stating that the mortagae company recieve the payment. I spoke with the attorney handling the case and he said that he would send a payment history. Well a man from the mortagae company called and told me which months they did not have. I told him I would fax him the information today. It has been almost 4 months that I heard from them and that now makes me 4 months behind because they would not except my payments. Can I turn around since I have all the proof the stress and all the above to counter sew them? Do I have to make all the late payment, and late fees and attorney fees since it was their fault and not minds? Any help would be good If you can not help Thanks for you time. Texas Resident

I am not sure I understand all the facts of your situation; however, assuming that you provided them with all the payments and that it was their error, then of course you would have grounds upon which to predicate a lawsuit. There are several federal and state regulations that govern the relationship between the mortgagor and mortgagee.
