Legal Question in Real Estate Law in Texas

What is the name of your state? TX

I am building a new home in a new subdivision. The Architechual Review Committee (ARC) Shut down my project in Dec. The had an issue with the color of my shingles.

We tried to work with them but each time they had another issue. Totally unreasonable people. I finally hired an attorney who is supposed to be tops in the field of real estate law. He did some research and found the Arc and hoa for this s/d has never filed with the county or state, and his position is they have no legal rights to shut anyone down. Ok that makes me feel better.

My concern is these people are acting so arrogant like they feel they will still win. My question is, is my attorney correct? This matter has been set for jury trial so I wondering if they can still win. Our attorney was recommended to us and seems like a straight shooter but we don't really know him.

An attorney would have to do the same research your current one did to answer this question. It sounds reasonable; maybe they think they have influence with the jury.
