Legal Question in Real Estate Law in Texas

Little League Park adjacent to our commercial land.

City just rec'd deed from RR for Little League Park.

City had park surveyed. Now renovating park, fence down and to be replaced. In this process, it was discovered that LL Park fence encroaches on our property between 2.5 to 3.5 feet.

Approached Mayor who states he told fence company to put new fence exactly where the old fence was regardless of property line established by licensed surveyor.

What are our rights in this situation?

Sue the city, and ask for an injunction preventing them from encroaching on your land.
