Legal Question in Real Estate Law in Texas
Lean on property due to an unpaid loan
Last year this time, I loaned my brother a large amount of money. He gave me a letter acknowledging the loan (photo of my check) and promising to pay it back when he sold his property. He now has his property up for sale and told me that he 'still had financial things he needs to do'. I know his circumstances such that he will not be able to pay me back after he sells his property. Can I put a lean on his home. God knows I don't want to but don't know what else to do.

Re: Lean on property due to an unpaid loan
Your letter is insufficient to file a lien. You will have to obtain a money judgment.
