Legal Question in Real Estate Law in Texas
Lease
We have been renting a space in this building for three years now going into our forth year. We teach TABC seminars
and until the Sept 11, it did hurt our business. Restaurants, hotels, and downtown restaurants are hurting because of the road contruction. We have made a request to our leasing company to move to a smaller office, they have three offices already vancant, but they will not allow us to move to one of these offices. They have raised the rent for the last two years.
We do not want to declare bankruptcy if we can help it.
my partner and I are retired, both females and we enjoy
teaching people. Please help us.

Re: Lease
If you have a written lease you may be stuck. If you are a month to month tenant you may give a one month notice in writing and terminate. If you are a holdover tenant, that is you originally had a lease and you continued to rent after the end of the term of the lease, it is necessary to read the lease to determine you rights. If the lease is silent you are probably a month to month tenant and can terminate, then lease or rent another space.
