Leaseback contract broken by new owners

We want to take the new owners to small claims court over the broken leaseback contract. Do we have to take them to court in Texas? (We sold our home in Texas and moved to California.) The new owners say they are keeping our deposit because one side of the fence started leaning after a wind storm happened after the lease was up. Are they able to keep the deposit for any reason?

Since the property is in Texas, the contrat was entered into in Texas, and the events that caused the problem occured in Texas plus the defendants are in Texas. The appropriate place to sue them is in Texas. However, you might try and get the law suit heard on one of the TV shows. At least that way some of your costs of travel, etc. may be covered.
