Legal Question in Real Estate Law in Texas

Who is legally responsible? I have 2 radio towers on my property. For the past year, one tower night time height light went out and I've desperately been trying to get hold of the owner. However, he has not paid for easement agreement we made and I've been trying to alert him that the light has been out (and I've also mailed letters to him). In the meantime, 2 months ago, the other tower light went out. Again, I called the owner and relayed the information that the light was out and needs to be replaced. Again, nothing. If, (heaven forbid) a plane was to crash into these two towers, who is responsible, the land owners or the tower owners? P.S. I've also contacted the FAA regarding these lights also. They also have contacted them. They fixed the lights, but went out again. I think the electricity has been turned off the one tower. What more can I do to eliminate this problem? Should I take these issues to a lawyer?
