Legal Question in Real Estate Law in Texas

letter from attorney regarding property

I was diovrece in 2005 and was given the house. I just received a letter from my ex's attorney stating I needed to call him. It states that the decree requires me to make timely payments and the ultimate refinancing of the property. I cannot refinance or get an assumption due to bad credit (I've tried). I pay on time. My area was declared a disaster zone during a recent hurricane, and the mortgage company stated I could skips payments without them holding me in default (due to the area being in a natural disaster zone). The company adjusted the payments for a year so that it would be higher a month, but I wouldn't be in default. Once again, I've been paying these on time.

Can my ex do anything to me to make me refinance or foreclose the home? I think I've been keeping up my end of the bargain. I'd love her name off of the mortgage, but that's out of my hands due to my credit.

I would contact the attorney and see what he has to say. You can explain your situation. It is possible they may have remedies, but, depending on whay he says, you may want to contact an attorney in your area to review the documents and assess your rights. Good luck.
