Legal Question in Real Estate Law in Texas

Lis Pendis in Texas filed against my Homestead

I am in the Real Estate Business. I sold an investment home to someone that apparently defrauded the mortgage company - and I am being named in the suit as a defendant - why? don't know - but in the meantime, this mortgage company has placed a Lis Pendis on my Homestead, and another rental home I own. How is this possible? They have no claims to my homes - the home that they are claiming is involved in Real Estate Fraud (listed on the Lis Pendis) has nothing to do with either of my other homes - is this legal???

Re: Lis Pendis in Texas filed against my Homestead

You need defense counsel -- NOW. Make sure you collect the following information immediately:

1. list of all people involved in the deal, and a short synopsis of how they're involved.

2. timeline of what happened (with dates, and who you spoke to and when).

3. list of all documents (index them by date, and have copies ready)

4. copies of the pleadings, and the date on which you received them.

Time isn't on your side at the moment. I can't answer your questions until I see your pleadings, though.
