Legal Question in Real Estate Law in Texas

i live in an apartment complex and the apartment above me is vacant but there is a huge hole in the outside wall up there. big rats have gotten in the hollow part between my apartment and the above one thaey have started scratching a digging trying to get down here. i have called and emailed the landlord several times
