Legal Question in Real Estate Law in Texas

I live in a neighborhood that I was told a few years ago there was no association. I checked them out and to my knowledge nothing is done with dues that homowner's pay. The neighborhood looks very crappy and there is a person that appointed himself as the president of the association. There are no annual meetings but every year he sents invoices and collects money from only certain homeowners. Supposedly no lot can have 2 homes in one property and there are several homeowners including the "President" that have 2 homes in one lot. How can I get the director/president of the HOA to return all money that he misused in the past years?

If the amount is under 10K, you can sue in small claims court. Otherwise, you will need an attorney.
