Legal Question in Real Estate Law in Texas

We live in Texas. My daughter bought a German Shepherd puppy from a breeder. He was supposed to come with papers but did not. Due to circumstances beyond her control she would like to sell the puppy. The puppy was not in the best shape when she got him, and she has had to take him to the vet and medicate him for him to recover. She posted an ad on craigslist to sell him for the best offer, without papers. The woman who sold the puppy to them is claiming that they are breaking a contract they signed saying that they were not allowed to sell the puppy to anyone else but her. My daughter has no copy of such a contract and the only piece of paper she does have does not say that. Can she really sue my daughter for breaking some contract by trying to sell the puppy?

Unfortunately anyone can sue for anything. Whether they win or not is another question. She will have to prove that a contract exists between daughter and breeder. If it is not in writing, she will need witnesses.
